This contract covers the following:

*All pups are guaranteed for 30 months against genetic defects from their date of birth.  Genetic Defects may include but not limited to hip dysphasia, spinal, heart, pancreas, severe, kidney defects, etc.  Must have 2 opinions from 2 unrelated veterinarians.  Seller reserves the right to have my vet or a vet of my choosing examine the pup at any time.  Opinions must reach same conclusion.  Unrelated vets is defined as two separate vets not working together or in the same facility. 

*Buyer must report trouble immediately to seller.  Buyer must get all vet records to seller within 10 days of reported trouble.  If condition is covered by “genetic defects” seller will replace pup (shipping is at the buyer’s expense), if one is available, or refund the selling price of the pup (this does not include shipping or any other expenses related to the situation.  If euthanasia is requested buyer must have this done to qualify for replacement pup or refund.  A letter from the attending veterinarian will be required.

*This warranty does not cover:  cherry eye, entropion, ectropion, umbilical hernia, inguinal hernia, loose hips or knees, heart murmur rated up to a 2, bacterial infection of any kind, fungus, parasitic infection, hypo plastic trachea, soft palate issues, respiratory infections, kennel cough, tail abnormalities, stenotic nares, cosmetic issues, lack of buyer knowledge, neglect, inaccurate diagnosis, or anything not included above.

*If pup is shipped commercially Buyer must contact Seller within 5 hours of its arrival to verify receipt and condition of the dog.  Contact is defined as a phone call or email only.  If this condition is not met no future guarantees can be made and contract may be void.

*Buyer should have the pup checked by a vet within the first 72 hours they have it. 

*This pup is current on shots and deworming.  Every effort has been made by seller to insure pups health.  Pup has been examined before arriving and appears to be in good health as will be stated on the state health certificate.  If pup is on medication prescribed by our vet buyer agrees to continue this treatment until it is completed.

*Pup is guaranteed against life threatening viral infection of Parvovirus or Distemper for 72 hours after pup leaves seller.  Buyer must have ELISA test performed if claiming viruses during the first 72 hours.

*If pup dies within 1 week of arrival to buyer, buyer agrees to pay for autopsy, or provide a vet statement of the cause of death.  If cause is found to be genetic or congenital, seller will replace pup (shipping is at the seller’s expense), if one is available or refund the purchase price of the pup (does not include shipping or other pup related expenses).  Seller reserves the right to have a vet consult on the cause of death.

*Buyer is responsible for all vet bills.  Seller does not agree to pay any vet bills unless prior arrangements have been agreed upon in writing between the buyer and seller.  Buyer agrees and acknowledges they are responsible for all vet bills once the pup comes to you.  Buyer is also responsible for all shipping costs.

*All pups are sold as pet quality only and seller makes no warranty on future soundness or quality-breeding or otherwise.

*Buyer understands that deposits are not refundable under any circumstances except if pup is found to suffer serious health problems by our vet before shipping.  Seller will inform buyer if such problems are found.

*Buyer understands the issues of the breed and its needs and agrees to provide premium food, proper preventative care, care of any hygiene needed and to house the pup correctly.  Buyer will keep pup current on shots and heartworm prevention.  Buyer is responsible for all/any conditions not specifically listed above. 

*Neglecting these contractual items, in part or all, renders this contract void and you give up your right to any compensation from seller.

*Buyer understands that seller must initial any additions or deletions to this contract.

*Buyer  agrees the jurisdiction and place of venue is Roberts County, SD

*This contract is intended only for the original owner and is not transferable.  Buyer has read and has been given a copy of this contract.  Seller neither makes nor implies any guarantee other than what is put forth in this document. 

*Buyer acknowledges that by signing this sales agreement that he or she assumes complete responsibility for the health and welfare of the above mentioned dog when it leaves the seller.  There is absolutely no guarantee regarding color, size or future breeding.  The seller assumes no responsibility on this pup after leaving the premises  for accidental death, non life threatening illnesses, landlord disapprovals, allergy to animal, disagreement with family, vet fees, and any other reason outside the bounds of the contract. Puppy can be returned anytime if buyer is unable to care for. .

Final Amount Due Before Shipping Takes Place.  Buyer Will Be Notified In Writing (can be mail, fax, or email) Of Shipping Date and Final Payment Due Date.  If Final Amount Is Not Received Before Shipping Buyer May Lose Previous Payment Due To Refund Policy Of The Commercial Shipper.       

Buyer acknowledges that if shipping cannot be arranged due to weather or unforeseen reasons the seller can return any deposits or payments made and the contract is void.  Further any other fees posted by the airlines due to kenneling in bad weather, plane delay, etc. is the responsibility of the buyer and must be paid to the airlines.

Special Notes:             
By Signing below the buyer agrees to the fees and any and all conditions as set forth in this sales contract as well as verifies that they are of age to enter into a legal contract.  Any misrepresentation on the part of the buyer will void this and all contracts between the buyer and seller.  Further any misrepresentation will be considered an attempt to commit fraud and will release the seller from any and all liability.
